Binding nature and functions of the jurisprudence of the Tribunal of the Roman Rota

Abstract

The present contribution aims to examine the value of jurisprudence and to offer a reflection to determine whether the functions attributed to it by the canonical legislation, endow it with obligatory nature, and whether consequently, the ecclesiastical tribunals of the particular churches, ought to resolve the causes according to the same criteria applied by the Tribunal of the Roman Rota. In this sense, it is convenient to begin by explaining the concept of jurisprudence and by analyzing in detail, the functions granted by the legislator, such as  a mean for interpreting the law and as a source to supply in case of lacuna legis.
